Here’s a quick breakdown on what an individual faces if they’ve been arrested on theft charges, such as shoplifting or taking items from a retail establishment.
A second degree misdemeanor (M2) conviction for theft is punishable by up to 60 days in jail and/or 6 months probation and a $500 fine.
This is usually the case in which the item(s) stolen-total less than $100.
A first degree misdemeanor (M1) for theft is punishable by up to 1 year in jail and/or 1 year probation and a $1000 fine.
This is usually the case in which the item(s) stolen-total between $100-$300. However, if the defendant has one prior theft conviction, then regardless of value of the item, the charges may be enhanced to a first degree misdemeanor.
