Under Florida law, the offense of Aggravated Battery on a Pregnant Victim is a second degree felony punishable by up to 15 years in prison and requires proof of a Simple Battery plus two additional elements which are:
- The victim was indeed pregnant on the date of the alleged battery; AND
- The defendant knew or should have known that the victim was pregnant at the time the battery was committed.
And in many instances, police in most Florida counties, including Okaloosa County, will not hesitate to arrest someone when a pregnant woman is a target of battery.
