Police in Okaloosa County have three goals in any investigation for drug possession or paraphernalia possession:
- The number one objective for any law enforcement officer is to attempt to get a statement from anyone regarding who was in control of the object. They will threaten all individuals that were near the object with an arrest unless someone confesses.
- They will take great pains in making the proximity of the object, in time and space, as close as possible to the person they seek to charge and the proximity of that object to other drugs or controlled substances. (for example: “on the floorboard or center console next to the defendant”).
- They are always looking for odor and residue that may look like a controlled substance so they can conduct “field tests.”
If they complete any of the three, they will usually arrest someone. If you or a family member has been arrested for possession of drugs or paraphernalia in Destin, Fort Walton Beach or elsewhere in Okaloosa County, give Lupella & Rehr a call at (850) 362-6655 for a free consultation.
